1) Who we are

By using this website and our online services you agree to these Terms of Service (“Terms”).

2) Scope & acceptance

These Terms govern your access to and use of botanico.pt, including bookings, voucher purchases (when available), event enquiries and any content or features we make available. If you disagree with any part, please do not use the website. We may update the Terms at any time; the “Last updated” date shows the current version.

3) Website use & your responsibilities
  • Use the site only for lawful purposes and in a way that does not impair its operation or the experience of others.
  • Do not introduce malware, attempt to gain unauthorised access, or misuse forms and interactive features.
  • You are responsible for the accuracy of information you submit (e.g., booking details, contact information, dietary notes).
4) Reservations (tables)

We may provide online reservations through a third-party booking provider (e.g., ResDiary). A reservation is confirmed when you receive our confirmation message (email/SMS/onsite).
Changes & cancellations. Please follow the instructions in your confirmation or contact us as early as possible to modify or cancel.
Late arrivals & no-shows. If you are running late, let us know; otherwise we may release your table for other guests. Repeated no-shows may lead to restrictions on future bookings.
Special requests & allergens. We will do our best but cannot guarantee special requests. If you have allergies or dietary requirements, inform our team before ordering.
Groups & events. Group reservations or private hire may require a deposit, minimum spend and specific cancellation terms communicated at the time of booking.

5) Prices, menus & service

All prices are in EUR and include applicable VAT unless stated otherwise. Menus, prices, operating hours, service offerings and promotions may change without prior notice. Photographs are illustrative only.

6) Gift vouchers & prepayments (if applicable)

Where offered, vouchers/prepayments are subject to the specific terms shown at purchase: validity, blackout dates, redemption instructions, and non-refundable conditions unless required by law. Vouchers are not for resale and have no cash value except where required by law.

7) Events & private dining

For private events we will confirm bespoke terms (deposit, schedule, menu, equipment, cancellation). Those terms prevail over these general Terms for the relevant event.

8) Third-party services & content

Our site may embed or link to services operated by third parties (e.g., ResDiary bookings, Tripadvisor badges, Google/YouTube media, maps, social platforms, Voucher Connect). We do not control those services and are not responsible for their availability, content or practices. Your use of third-party features is subject to the third party’s terms and privacy policies.

9) Intellectual property

All trademarks, logos, photographs, menus, text, graphics and other materials on this site are owned by or licensed to Botânico and are protected by intellectual-property laws. You may not copy, modify, distribute or use the content for commercial purposes without our prior written consent.

10) Privacy & cookies

We process personal data in accordance with the EU General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and Portuguese data protection law. For details, including your rights and how to contact us, see our Privacy Policy and Cookie Policy (available on this site). Where required, we obtain your consent for analytics/marketing cookies and for third-party embeds.

11) Disclaimer of warranties

The website is provided on an “as is” and “as available” basis. We make reasonable efforts to keep information accurate and the site secure but do not warrant that it will be uninterrupted, error-free, or free from malware. To the fullest extent permitted by law, we disclaim all warranties, express or implied, relating to the site and its content.

12) Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence or for fraud). Subject to the foregoing, we will not be liable for: (a) indirect or consequential losses; (b) loss of profits, revenue, data, goodwill; (c) failures caused by events beyond our reasonable control; or (d) the acts/omissions of third-party providers.

13) Force majeure

We are not responsible for failures or delays caused by events outside our reasonable control (e.g., power outages, strikes, extreme weather, governmental restrictions or public-health measures).

14) Changes to the website & Terms

We may change, suspend or discontinue any part of the website and these Terms at any time. Continued use after changes means you accept the updated Terms.

15) Governing law, jurisdiction & ADR

These Terms are governed by Portuguese law.
According to Law No. 144/2015, in the event of a consumer dispute you may refer the matter to Centro de Arbitragem de Consumo do Algarve – Tribunal Arbitral (Alternative Dispute Resolution). You may also use the EU Online Dispute Resolution (ODR) platform. Using ADR is without prejudice to your right to bring proceedings before the competent courts.

16) Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in force. No failure or delay to enforce a provision constitutes a waiver. These Terms constitute the entire agreement between you and us regarding website use.
